Terms of Service

1. Parties and subject

These Terms of Service ("Terms") form an agreement between Adem Coşar (Hadımköy Hastane Mah. Şehmuz Sok. No: 13, İstanbul / Arnavutköy; national ID: 10889513522) ("Gainzor", "we") and you, the individual who registers for the Gainzor mobile app ("you", "User"). The agreement is concluded electronically when you approve these Terms during registration.

Our Privacy Policy, Cookie and Local Storage Policy, Subscription Terms and Refund and Withdrawal Policy form an integral part of these Terms.

For users in Türkiye, the binding Turkish text is the Kullanıcı Sözleşmesi; this English version is provided for convenience and, in case of a discrepancy in meaning, the Turkish text prevails.

2. What the service is

Gainzor provides:

• Training plan and routine building, workout logging and a rest timer,
• An exercise library and the ability to create your own exercises,
• Statistics, muscle distribution analysis and personal record tracking,
• Body measurement and weigh-in tracking (subject to explicit consent),
• An achievement and badge system,
• A social feed: posting, following, likes and comments,
• An AI-assisted training coach (expanded use with Pro/AI Plus).

The service is provided "as is". We may improve, change or discontinue features. Changes that materially reduce your existing rights follow the process in section 15.

3. Accounts

• You register with an email address and password, or with a Google account.
• You confirm that the information you provide is accurate and kept up to date.
• You are responsible for keeping your credentials confidential and for everything done through your account. Tell us without delay if you suspect unauthorised use.
• One person should hold one account. Creating a new account to evade a ban breaches these Terms.
• Accounts are personal; they cannot be transferred or made available to third parties.

4. Age limit

Gainzor may not be used by anyone under 16. By registering you confirm that you are at least 16 years old.

If you are 16 or older but under 18, you need the consent of a parent or guardian both to use the app and to purchase a Pro or AI Plus subscription. By using the app you confirm that this consent has been obtained.

We close accounts we find to belong to someone under 16 and delete the associated data without delay.

5. Health disclaimer

Training plans, exercise descriptions, statistics, volume suggestions and AI Coach responses are provided for information and personal tracking only. You:

• Must consult a healthcare professional before starting a new training programme, particularly if you have an existing condition or injury, a chronic illness, or are pregnant;
• Decide for yourself, in light of your own health, what weight to lift, which movements to perform and at what intensity;
• Must stop immediately if you feel pain, dizziness, chest tightness or any similar symptom while training;
• Are responsible for performing exercises with correct technique and, where necessary, under qualified supervision.

We are not liable for injury or health problems arising from your use of the app. Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be excluded by law.

6. What the AI Coach is

• The AI Coach is an assistive tool built on a large language model. Its output can be wrong, incomplete or out of context.
• It does not give medical, nutritional, pharmaceutical or supplement advice, and its answers are not a medical opinion.
• Accepting, editing or rejecting a suggested plan is entirely your decision. A suggestion creates no rights or obligations.
• We do not warrant the accuracy, completeness or fitness for a particular purpose of AI Coach responses.
• Usage limits apply to prevent abuse (automated requests, attempts to circumvent allowances, attempts to make the model produce harmful content). Access may be restricted if they are breached.

7. Acceptable use

You agree not to:

• Break the law, act against public morals, or breach these Terms,
• Infringe anyone's personal rights, intellectual property or privacy,
• Post insults, hate speech, harassment, threats, discrimination or incitement to violence,
• Post sexual content, nudity or obscene material,
• Impersonate another person or organisation, or create fake accounts,
• Post advertising, spam, chain messages or unauthorised commercial promotion,
• Promote or broker the sale of performance-enhancing substances, medicines or prescription products,
• Overload our infrastructure, use bots or automated scripts, or scrape data,
• Reverse engineer, decompile or attempt to circumvent security measures,
• Attempt to access other users' accounts without authorisation,
• Copy or reproduce the service to build a competing product.

8. Your content

You own your content. We claim no ownership over anything you create or upload.

You grant us a non-exclusive, royalty-free licence to store, reproduce, technically process, reformat (thumbnailing, compression) and deliver your content to the audience you selected — and only to the extent needed to operate the service. This licence:

• Ends when you delete the content or close your account;
• Does not cover advertising, marketing or promotional use. If we ever want to feature your content, we will ask you separately and explicitly;
• Includes no right to sublicense, other than to the hosting and content-delivery providers technically required to serve it.

You confirm that you hold the necessary rights to what you post, that you have the consent of anyone appearing in it, and that it does not infringe third-party rights. You are responsible for claims arising from a breach of this.

9. Moderation and reporting

• You can report a post or a user from inside the app.
• We may remove content, restrict access to it, or suspend or close an account that breaches these Terms or the law.
• Where content is removed we will, as far as practicable, tell you why and give you a way to appeal. Appeals go to info@gainzor.com.
• For urgent and severe breaches (child abuse material, threats of violence, clear criminal content) we may act immediately, without prior notice, and report the matter to the authorities.
• We have no obligation to pre-screen user content.

10. Paid subscriptions — Pro and AI Plus

• The core features (workout logging, a limited number of plans and routines, general statistics, data export, the social feed) are free on the Free tier. The Free tier is limited to 3 free-form routines, 1 plan, 5 custom exercises, a 90-day statistics window and 5 AI Coach messages per 30 days.
• Gainzor Pro gives unlimited plans, free-form routines and custom exercises, access to your full statistics history, the weekly muscle analysis, up to 4 media per post including video, and AI Coach chat up to 10 messages a day.
• Gainzor AI Plus includes everything in Pro and adds the features where the AI generates content for you or interprets your data: up to 10 generated plans a month, building a workout straight from chat, statistics and plan interpretation, plan revision, workout analysis, the weekly report, and AI Coach chat up to 50 messages a day. These features are not available on the Free or Pro tiers.
• AI allowances are subject to daily and monthly numeric limits, and wide-context AI operations are additionally capped at 8 a day. Current limits are shown in the app and may be changed with prior notice.
• Pro and AI Plus are purchased only inside the app, through the Apple App Store or Google Play. Payment, invoicing and refunds are handled by that store under its own terms.
• Subscriptions renew automatically at the end of each period unless cancelled. Cancel at least 24 hours before the renewal date, in the store's subscription settings.
• Current pricing, period length and any trial are shown on the store's product page.

• Deleting your account does not cancel your subscription. Cancel it separately through the store.

11. Intellectual property

The software, interface design, the "Gainzor" name and logo, the exercise library and all content we produce belong to us or our licensors.

For the duration of these Terms you receive a non-exclusive, non-transferable, non-sublicensable right to use the app for personal, non-commercial purposes. It does not include copying, modifying, distributing or creating derivative works.

12. Data, backups and availability

• Your data is stored primarily on your device; the cloud copy exists for syncing and for protecting you against data loss when you change device.
• We take reasonable backup measures, but we recommend exporting your own data periodically via Settings → Export data.
• We do not guarantee uninterrupted, error-free operation or any particular speed. Outages can occur during maintenance, updates, provider incidents or force majeure. Planned maintenance is announced in advance where possible.
• If you lose your device, uninstall the app or wipe its data, anything not yet synced to the cloud may be unrecoverable.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, or the acts of third parties, except where caused by our wilful misconduct or gross negligence.

In particular, we are not responsible for:

• Your own training decisions and their health consequences,
• Content posted or conduct engaged in by other users,
• Problems caused by your internet connection, device or operating system,
• Interruptions or changes in third-party services (the stores, infrastructure providers).

14. Termination

• You may terminate at any time by deleting your account in Settings. This deletes your cloud data and cannot be undone.
• We may suspend or close an account that breaches these Terms. Except for severe breaches, we will give you reasonable notice and an opportunity to put things right.
• If we decide to discontinue the service entirely, we will give at least 30 days' notice and keep the export feature available during that period.
• If we wrongly close an account with an active Pro or AI Plus subscription, we will support your refund request with the relevant store for the unused period.
• Termination does not affect rights and claims that arose before it. Sections 11, 13 and 16 survive termination.

15. Changes

We may change these Terms. The current version is always published at this address. Material changes to your disadvantage — particularly to pricing, liability or your content rights — will be announced in the app or by email at least 15 days before they take effect.

If you do not accept a change, you may close your account before the effective date. Continuing to use the service after that date means you accept it.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of habitual residence, and you may bring proceedings in the courts of that country. Consumers in Türkiye may apply to the Consumer Arbitration Committees or Consumer Courts within the monetary thresholds set annually by the Ministry of Trade. For non-consumers, the courts and enforcement offices of Istanbul have jurisdiction.

If any provision is held invalid, the remaining provisions stay in force.
