Refund and Withdrawal Policy

These subscriptions are not yet on sale. This policy takes effect when the subscription is made available in the app. Square-bracketed fields must be completed before launch.

1. Short summary

Not binding; it does not replace the full document.

  • Subscriptions are bought through the Apple App Store or Google Play, so refund requests go to that store first.
  • Because the digital service is delivered instantly, the statutory right of withdrawal does not apply — but that does not mean you cannot get a refund.
  • The stores' own refund policies apply, and refunds are granted in many situations.
  • If the service is defective — a promised feature isn't delivered, or there's a prolonged outage — your statutory remedies apply and you can use them against us.
  • If the store won't help, write to info@gainzor.com; we respond within 15 days.

2. Why the right of withdrawal is excluded

Article 15/1-(ğ) of the Turkish Distance Contracts Regulation excludes the right of withdrawal for "services performed instantly in electronic form and intangible goods delivered instantly to the consumer". The EU Consumer Rights Directive contains an equivalent exemption in Article 16(m).

Gainzor Pro or Gainzor AI Plus is unlocked the moment payment is confirmed. On the purchase screen you consent to immediate performance, and with that consent your 14-day withdrawal right ends. This is disclosed before purchase in the Subscription Terms.

This exclusion concerns only the statutory right of withdrawal. It does not affect the rights described in sections 3 and 5 below.

3. What you keep regardless

  • Store refund policies. Apple and Google assess refund requests under their own terms. In practice refunds are frequently granted, especially for accidental purchases and requests made soon after buying.
  • Rights for defective service. If the service does not have the promised characteristics, statutory remedies apply (see section 5).
  • Unauthorised purchases. If someone used your account without permission, you can ask the store to reverse the charge.
  • Minors. Where a user under 18 purchased without parental or guardian consent, a refund can be requested through the store; we will support that request.
  • Price increases. Price changes are notified before renewal; if you don't accept, cancel before the renewal date. If an increased amount was charged without notice, you can ask for it back.

4. How to request a refund

Because the store collects the payment, the store also issues the refund. Send your request to the store first.

4.1 Apple App Store (iOS)

  1. Go to reportaproblem.apple.com and sign in with your Apple account.
  2. Select the Gainzor purchase.
  3. Choose "Request a refund" and give your reason.
  4. You can also start from Settings → your Apple account → Media & Purchases → Purchase History.

4.2 Google Play (Android)

  1. In the Google Play app go to Profile → Payments & subscriptions → Budget & order history.
  2. Select the Gainzor order and choose "Request a refund".
  3. You can also use play.google.com/store/account/orderhistory.

4.3 Contacting us

If the store does not resolve it, or your request is based on the service being defective, write to info@gainzor.com. Including the following speeds things up:

  • The email address registered to your account,
  • The purchase date and the store order number,
  • Your reason and, if you have one, the store's reply.

We reply within 15 days. Where the request is justified, we support the refund with the store and confirm our approval to them where needed.

5. If the service is defective

The service is defective if it lacks the agreed or promised characteristics. For example:

  • A feature you bought Pro or AI Plus for is never unlocked,
  • The AI Coach is unusable for a prolonged period for reasons attributable to us,
  • A feature promised in our marketing is removed from the subscription.

In those cases you may require:

  • Performance of the service again,
  • Free repair,
  • A price reduction proportionate to the defect,
  • Withdrawal from the contract and a refund of what you paid.

These rights are unaffected by the withdrawal exclusion and can be exercised directly against us. Where a defect exists, we refund the unusable period pro rata.

If you only want to stop being charged again, cancelling is enough — you don't need to request a refund. Cancel at least 24 hours before the renewal date.

7. Timing and method

  • How long a store takes to assess a request is governed by that store's policy; it is usually a few business days.
  • We answer requests sent to us within 15 days.
  • Refunds are made using the original payment method, by the store that collected the payment. How quickly it appears depends on your bank.
  • We charge no fee or deduction for processing a refund.

8. Out of scope

The following are not, on their own, grounds for a refund:

  • Buying a subscription and then not using it,
  • Changing your mind (given the withdrawal exclusion for digital services),
  • Forgetting to cancel before automatic renewal — you can still ask the store, which may refund under its policy,
  • The service being unusable because of your internet connection, device or operating system version,
  • AI Coach answers not matching your expectations. The AI Coach is an assistive tool and does not guarantee a specific outcome; this is not a defect,
  • An account justifiably suspended or closed for breaching the Terms of Service.

9. If you're not satisfied

If we refuse your request, consumers in Türkiye may — within the monetary thresholds set annually by the Ministry of Trade — apply to the Consumer Arbitration Committee or the Consumer Court at their place of residence or where the transaction took place. Applications can also be filed through the Consumer Information System (TÜBİS) on e-Devlet.

Consumers resident in the EU or the UK retain the mandatory remedies and forums of their country of habitual residence.

You do not have to contact us before using those routes, but most requests can be settled directly, so it's usually quicker to write first.
